Subject: Letter from Joe Becraft WCID President to Stan Farmer HSB City Manager, Reference Deerhaven Agreement Regarding Fire-Fighting Services

To All Deerhaven Property Owners:

As you are aware, our fire protection agreement with HSB renews each year. The contract goes to the HSB City Council on Sept 20. There were a number of conditions in the original contract. Below is the letter I recently sent to Stan Farmer, HSB City Manager, updating him on the progress we've made on those requirements.

Subject: Deerhaven Agreement Regarding Fire-Fighting Services

Dear Stan,

As we approach the time for renewal of our fire protection agreement, we'll update you on the progress we've made on the conditions set forth in your September 13, 2010, transmittal letter and the agreement itself:

a. We"ve cleared the heavy brush from around the homes with the most serious problems in Deerhaven.

Several other lots were cleared voluntarily by owners and we have commitments on a number of others.

We are now asking all vacant lot owners to consider cleaning up the brush on their properties.

We have have authority to require this and will do so as necessary.

b. We have posted warning signs at our low-water crossings.

Gates are not practical considering our demographics and lack of public personnel to man them.

c. We have plenty of access for Turbo-Draft appliances. We are not aware that the HSB fire department has surveyed the possibilities. We'll be happy to work with them.

d. We have completed preliminary engineering on the first phase of our water system improvement project. Phase 1 will meet the International Fire Code (adopted by HSB, we understand) including 1000 gpm fire flow with a minimum pressure of 20 psi under combined fire flow and drinking water conditions. This assumes the City will deliver water in sufficient volumes and at sufficient pressures to meet the 20 psi requirement as well as the TCEQ's 35 psi requirement anywhere on the system. 13 new fire hydrants will be installed in this phase.

At the completion of Phase 1, no lot or residence will be more than 1000 feet from a fire hydrant, as specified in our fire protection agreement. 75% of residences will be within 500 feet and 91% within 700 feet. We believe Ralph Hendricks gave you a plat of the fire hydrant layout. We are available to meet with Chief Fiero on this plan at his convenience.

We are currently working on a financing plan with the Deerhaven POA. We expect funding to come from the Texas Water Development Board. That funding would be underwritten by the Deerhaven WCID's taxing authority. We are planning on a May, 2012, election preceded by public meetings.

e. We are working with our residents on residential signage and many have complied. We will renew this effort as needed. We believe our street signage is adequate.

f. We have no security gates.

We continue to make a "good faith" effort to address your requirements. We will be pleased to discuss any of these issues with you.

Sincerely,

Joe Becraft                                                     Renea Latham

Re:  Deerhaven Fire Protection Contract with Horseshoe Bay

The WCID has signed a fire protection agreement with Horseshoe Bay effective November 1, 2010, for an initial term of one year.

This contract is the same as those in effect with Blue Lake, Oakridge, and The Hills, with the exception of several conditions applicable to Deerhaven that will need to be met if we expect to have the term extended.

Horseshoe Bay has assured us that they will be reasonable in judging our progress in meeting these conditions. By signing this agreement Horseshoe Bay becomes our first responder.

Specifically, Horseshoe Bay asks the following:

     1.    We need to upgrade our water system to increase the number and capacity of fire hydrants.  We determined our need to upgrade the system a number of

years ago. This reinforces that need. If we want competent fire protection, we must improve our water system.

     2.  Heavy brush should be cleared, especially around homes.

     3.  Warning signage needs to be installed at our low water crossings.

     4.  Access needs to be provided to the Lake so that "Turbo-Draft" appliances can be used for fire fighting.

     5.  Insure that street and house number signage is highly visible.

     6.  Meet certain HSB ordinances relative to outdoor burning, fireworks, and outdoor welding/cutting.  Much of this is already covered by our existing

restrictions. We'll post these on the website.

Fire protection by Horseshoe Bay has been our best alternative, but unavailable until now.  If we meet their conditions, most of which we need to be doing anyway, we should be able to insure long-term fire protection.

A benefit of this is that our homeowner's insurance may enjoy better ratings and lower rates.

We want to acknowledge the efforts of Tom Armagost in this long struggle for fire protection and also Ralph Hendricks for working with the HSB City Manager to reach understandings on several issues.

Horseshoe Bay will also send you a letter concerning this agreement in the near future.

THE DEERHAVEN POOL

The renovations to the Deerhaven Pool are complete and some new poolside furniture has been purchased for everyone's comfort.  The pool renovations and new furniture were paid for from POA and beautification funds, your money, so it behooves everybody to treat the pool and furniture as if it were their own, to keep it clean and a pleasure to use for all.
